2. Entry Period/Eligibility:

   The Somatic Optics Lost Sunglasses Giveaway ("Contest") begins on February 4, 2008 at 12:01 A.M. EASTERN STANDARD TIME ("EDT") and ends on April 21, 2008 at 11:59 P.M. EASTERN DAYLIGHT TIME ("EDT") ("Contest Entry Period"). Somatic reserves the right to extend the contest time period and to award additional winners. Contest is open to legal residents of the 50 United States and District of Columbia. All Contest submissions become the sole property of the Sponsor and will not be returned or acknowledged. Void where prohibited by law.
   
   By submitting your missing sunglasses story, you grant the Sponsor and its agents the right to record, copy, publish, edit, exhibit, distribute, merchandise, license, sublicense, adapt and/or modify your submission in any way in any and all media, without limitation and without any compensation. Sponsor at its sole discretion reserves the right to post your submission on www.somaticsunglasses.com and/or www.myspace.com/somaticsunglasses during or after the Contest Entry Period. This posting does not deem your entry a winner. You agree to abide by these Official Rules and the decisions of the Sponsor, which are final and binding in all respects.
   
   Employees of Somatic Optics, their families, representatives, and employees of its advertising and public relations agencies are not eligible to enter the contest.

3. Contest Entry:

   A contest entry is a missing sunglasses story and a completed contact information form. Please follow the submission instructions found on http://survey.constantcontact.com/survey/a07e28biyx0fbtov6aa/start. (Will be filled in once survey is complete.)

4. How to Enter:

   Go to www.somaticsunglasses.com and click on the link for the contest, or go to www.myspace.com/somaticsunglasses and click on the link for the contest, or go directly to http://survey.constantcontact.com/survey/a07e28biyx0fbtov6aa/start and complete the entry form. In the event of a dispute, entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. "Authorized Account Holder" means the natural person who is assigned to an email address by an Internet access provider or online service provider or any other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.

5. Limitation to Entry:

   There is a limit of one entry per story per person. Multiple entries telling the same story from a single person will result in disqualification of all entries received from that entrant.

6. Winning:

   One winner will be chosen randomly every two weeks throughout the three month Contest. Once you have won, you will be ineligible to win additional pairs of free sunglasses associated with this Contest. There will six winners total for this Contest.

7. Winner Notification:

   The bi-weekly winner will be notified via email and/or phone. If the winner is not reachable via email and/or phone within 10 days, another winner will be chosen.
8. BY ACCEPTING THE PRIZE, THE WINNER AGREES THAT THE SPONSOR, ITS, PARENT, SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF THE SPONSOR'S OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY WINNER FOR ANY LIABILITY FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS CONTEST OR PARTICIPATION IN ANY CONTEST OR PRIZE RELATED ACTIVITY OR CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, MERCHANDISE DELIVERY OR THE VIOLATION OF ANY INTELLECTUAL PROPERTY RIGHTS, INCLUDING COPYRIGHT INFRINGEMENT AND TRADEMARK INFRINGEMENT.

9. Rights Granted:

   There is no cost or fee to enter this Contest.
   NO PURCHASE NECESSARY. This contest is entirely voluntary. Submission of an Entry grants the Sponsor and its agents the right to record, copy, publish, use, edit, exhibit, distribute, license, sublicense, adapt and/or modify submissions in any way, in any and all media, without limitation and without compensation to the entrant. Submission of an Entry further constitutes the entrant's consent to irrevocably assign and transfer to Sponsor any and all rights, title and interest in the submission, including, without limitation, all copyrights.

10. Prize:

    6 Prize Winners will receive a free pair of Somatic Sunglasses (est. value $50-$75). No transfer of prize is permitted except at the sole discretion of Sponsor.

11. Internet:

    Sponsor is not responsible for lost, late, mutilated or illegible entries nor for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or presenter on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, or suspend the Contest. In the event of early termination all entries received at the time of termination will be judged. Caution: Any attempt by a contestant to deliberately damage any website or undermine the legitimate operation of the contest is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such contestant to the fullest extent of the law.
